Terms of Use

1. Eligibility and Accounts

• You must be at least 13 years old to use the Services.
• You agree to provide accurate information and keep account information up to date.
• You are responsible for safeguarding your account credentials.

2. Description of Services

Trip7 provides travel-planning and itinerary support tools, including AI-assisted summaries, organizational features, and contextual travel guidance. Features may change over time, and some features may be in beta.

3. AI-Assisted Outputs and No Professional Advice

Some Services features use artificial intelligence to generate summaries, suggestions, and other outputs. AI-generated output may be incorrect, incomplete, outdated, or not suitable for your circumstances, and similar output may be generated for other users.

You are responsible for evaluating and verifying any output before relying on it, including checking critical details with official sources.

The Services provide informational assistance and are not legal, medical, financial, insurance, or other professional advice. You remain responsible for travel decisions, bookings, and compliance with local laws.

Do not rely on the Services as your sole source for high-impact decisions, emergency planning, or professional determinations.

4. Acceptable Use

You agree not to:

• Use the Services for unlawful, harmful, or fraudulent activity.
• Interfere with, disrupt, or attempt unauthorized access to the Services.
• Reverse engineer, scrape, or copy the Services except as permitted by law.
• Upload content you do not have rights to use.
• Upload or process personal information of third parties without their explicit consent.
• Use the Services to develop competing products using unauthorized means.
• Misrepresent AI-generated output as solely human-generated where disclosure is required by law.

5. User Content and Inputs

You retain ownership of content you submit to the Services (such as trip details and messages). You grant Trip7 a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform that content in connection with the operation, promotion, and improvement of the Services, consistent with our Privacy Policy.

You represent that you have the rights necessary to submit any content you provide.

If you provide us with any feedback, suggestions, or ideas regarding the Services ("Feedback"), you grant Trip7 a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into our products and services without any obligation or compensation to you.

6. Third-Party Services

The Services may integrate with third-party platforms (for example, email or calendar providers). Your use of third-party services is governed by their terms and policies, and Trip7 is not responsible for third-party services.

7. Beta Features

Pre-release or beta features are provided "as is" and may contain errors or change without notice. We may modify, suspend, or discontinue beta features at any time.

8. Fees and Billing

The current beta is offered at no charge. If paid plans are introduced, pricing, billing cycles, and renewal terms will be shown at purchase and may be subject to additional plan terms.

9. Intellectual Property

The Services, including software, design, trademarks, and related content, are owned by Trip7 or its licensors and protected by intellectual property laws. Except as expressly authorized, no rights are granted to you.

10. App Store Sourced Applications

If you access the Services through an application downloaded from the Apple App Store or Google Play, these Terms are between you and Kumino AI Inc., and not with Apple Inc., Google LLC, or their affiliates.

Apple and Google have no obligation to furnish any maintenance, support, or other services for the app.

Apple and Google are not responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar laws.

Apple and Google are also not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the app or your use of it infringes that third party's intellectual property rights.

Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of them, will have the right to enforce these Terms against you as a third-party beneficiary.

11. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Trip7 does not warrant that AI-generated output will be accurate, complete, current, non-infringing, or fit for any particular purpose.

12. Limitation of Liability

To the maximum extent permitted by law, Trip7 and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business opportunity, arising from or related to the Services.

To the maximum extent permitted by law, Trip7's total liability for any claim arising out of or relating to the Services will not exceed CAD $100.

13. Indemnification

You agree to defend, indemnify, and hold harmless Trip7 and its affiliates from claims, liabilities, damages, and expenses arising out of your use of the Services, violation of these Terms, or infringement of rights of another party.

14. Suspension and Termination

We may suspend or terminate access to the Services at our discretion, including for violation of these Terms or security reasons. You may stop using the Services at any time.

If your account remains inactive for 18 months, we may send a notice to your account email and, if there is no reactivation within 30 days after notice, we may close your account and delete or anonymize associated data, subject to legal or security retention requirements.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

To the extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by confidential, binding, individual arbitration in Ontario, Canada. You and Trip7 waive any right to a jury trial and any right to participate in a class action or representative proceeding.

Either party may bring an individual claim in small claims court where eligible. If any portion of this dispute section is found unenforceable, the remainder will continue in effect to the maximum extent permitted by law.

Please note that if you are a consumer residing in Ontario, or another jurisdiction where applicable law prohibits mandatory arbitration and class action waivers in consumer contracts, the arbitration and class action waiver provisions above will not apply to you, and you may resolve disputes in the competent courts of your jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date and provide additional notice where required by law. Continued use after updates means you accept the revised Terms.
